Terms and conditions for purchases from Calistria

§ 1 General framework

These Terms and Conditions govern all Calistria sales transactions.

The prices stated are in euros, exclusive of VAT and excluding shipping costs.

A purchase from Calistria requires you to be 18 years old.

Calistria reserves the right to make changes and corrections.

If there are any misunderstandings, we strive for a fair and customer-friendly solution.

Customers undertake to comply with the legal framework of their country and to hold Calistria harmless from any legal violations.

The currently valid legal regulations must be applied.

Our plants are intended exclusively for ornamental purposes.
§ 2 Scope

These General Terms and Conditions apply to all purchase contracts with Calistria in their current version.

The validity of the remaining text of the General Terms and Conditions remains unaffected by any ineffectiveness of individual provisions.
§ 3 Right of withdrawal

All sales are final.
§ 4 Delivery conditions

Delivery usually takes place within 2-4 working days unless express shipping has been booked.

Shipping costs vary depending on the delivery country.
§ 5 Payment modalities

Payments are made in advance no later than 48 days after the order is placed by bank transfer, Paypal or Crypto
§ 6 Warranty

Ornamental plants are excluded from the statutory warranty
§ 7 Transport damage

If there is any obvious transport damage, please report it immediately.

The report does not affect the customer's warranty rights.

In the event of the plant being lost or completely dying, we will make a replacement delivery upon receipt of photographic evidence of the dead cutting.
§ 8 Disclaimer of liability

Calistria is only liable in cases of proven intent or gross negligence.

No liability for consequential damage or financial loss to business customers.

Liability for the accuracy of publication information is excluded.
§ 9 Retention of title

The goods remain the property of Calistria until full payment has been made.
§ 10 Liability clause

The statutory liability regulations apply.
§ 11 Data protection regulations

Customer data is used exclusively for internal purposes and is treated confidentially.
§ 12 Legal basis and place of jurisdiction

Austrian law applies; The place of jurisdiction is the headquarters of Calistria.

For consumers, the regulations of the country of residence also apply.
§ 13 Youth Protection
Age Verification
1.For items in your order that are only permitted to be sold to individuals of a certain age, we guarantee through a proven system, which includes both an identity check and an age verification, that the buyer meets the required minimum age. Delivery is made by the courier only after a successful age verification and exclusively to the buyer directly.
§ 14 Final Provisions
1.The ornamental plants we offer are intended exclusively for use in the botanical field. Continuous exposure to at least 18 hours of light per day, whether artificial or natural, is necessary to prevent the formation of flowers and fruiting bodies. Should a buyer intend to produce intoxicants from any of our plants, this would lead to legal consequences in accordance with the Narcotics Act.

2.If our sales personnel become aware of such intentions, we are legally obliged to refuse the sale or revoke an existing contract.

3.By concluding the purchase contract, the purchaser commits to not using the purchased ornamental plants for illegal activities.

4.Our products are sold only to individuals who are at least 18 years old.
